Summary
Eelnõu kiidab heaks muudatused, mis puudutavad meretöölepingu kehtivust ja laevapere liikmele töötasu maksmist olukorras, kus laevapere liiget peetakse seoses laeva vastu suunatud piraatlusjuhtumi või relvastatud rööviga ebaseaduslikult kinni. Muudatuste kohaselt on reederil kohustus jätkata töötasu maksmist olukorras, kus laevapere liige on seoses laeva vastu suunatud piraatlusjuhtumi või relvastatud rööviga vangistatud. Reederil tuleb siis jätkata laevapere liikmele töötasu ja muude tasude maksmist, mis tulenevad meretöölepingust, kollektiivlepingust või seadusest. Reederi kohustus kehtib kuni laevapere liikme kojusõiduni või kui laevapere liige kinnipidamise ajal sureb, siis laevapere liikme surmani. Muudatuste siseriiklikult rakendamiseks on Sotsiaalministeerium algatanud meretöö seaduse muutmise seaduse eelnõu, millega muudetakse seadust vastavalt konventsiooni muudatustele. Muudatused mõjutavad reedereid, kelle laevadel on meretöötunnistus. Riigikogu ratifitseeris meretöö konventsiooni 23. veebruaril 2016 ja see jõustus Eesti suhtes 5. mail 2017. Meretöö konventsiooni muudatused jõustuvad Eesti suhtes kuus kuud pärast seda, kui Eesti on teatanud Rahvusvahelise Tööbüroo peadirektorile muudatuse heakskiitmisest.
