Summary
Eelnõuga luuakse alaealisele lapsele elatise kindlaksmääramise kord, mis vastab Eesti elustandardile ja on paindlik. Eelnõus määratakse uued kriteeriumid, mida tuleb elatise summa kindlaksmääramisel arvesse võtta. Eelnõu kohaselt kujuneb elatise summa lapse reaalseid vajadusi, kohustatud isiku võimalusi ja tema poolt lapsega koos veedetava aja hulka, ülalpidamist saama õigustatud laste arvu ning perele makstavat lapsetoetust ja lasterikka pere toetust arvesse võttes. Eelnõuga asendatakse senine miinimumelatise summa, milleks on pool valitsuse kehtestatud kuupalga alammäära, õiglasemate ja paindlikumate elatise arvutamise alustega. 2021. aastal on miinimumelatise summaks 292 eurot kuus ühe lapse kohta. Seletuskirjas märgitakse, et praegune miinimumelatis ei täida enam kohtumenetluses lihtsustavat funktsiooni ega pruugi kaitsta ka elatist saava lapse huve. Seni elatise kindlaksmääramisel aluseks võetud töötasu alammäär on valdava osa kohustatud isikute jaoks liiga kõrge. See ei kajasta lapsele tehtavaid tegelikke kulutusi, elatist saavate laste arvu, kohustatud isiku varalist seisundit ega tema poolt lapsega koos veedetava aja hulka. Miinimumpalga kiire tõusu tõttu on paljud elatist maksma kohustatud vanemad tahtmatult võlgniku staatusesse sattunud, kuna miinimumelatise maksmine käib neile üle jõu. Samal põhjusel tuleb üha sagedamini ette ka algselt erandina planeeritud elatise vähendamist alla miinimumi. Eeltoodust tulenevalt on elatisvaidluste lahendamine kohtus muutunud keerukaks, tuues pooltele sageli kaasa suured õigusabikulud ja ajakulu.
