Summary
Eelnõuga tehakse Austria Vabariigi, Belgia Kuningriigi, Hispaania Kuningriigi, Luksemburgi Suurhertsogiriigi, Madalmaade Kuningriigi, Prantsuse Vabariigi ja Saksamaa Liitvabariigi vahelise eelkõige terrorismi-, piiriülese kuritegevuse ja ebaseadusliku rände vastases võitluses piiriülese koostöö tõhustamise lepinguga ühinemise seaduses (edaspidi Prümi seadus) tehnilised muudatused, mis puudutavad Austria Vabariigi, Belgia Kuningriigi, Hispaania Kuningriigi, Luksemburgi Suurhertsogiriigi, Madalmaade Kuningriigi, Prantsuse Vabariigi ja Saksamaa Liitvabariigi vahelise eelkõige terrorismi-, piiriülese kuritegevuse ja ebaseadusliku rände vastases võitluses piiriülese koostöö tõhustamise lepingu (edaspidi Prümi leping) kohaste riiklike kontaktpunktide, riiklike kontakt- ja koordineerimispunktide ning pädevate asutuste ja ametnike määramise deklaratsiooni tegemist ja muutmist. Muudatusega jäetakse seadusest välja riiklikud kontaktpunktid, riiklikud kontakt- ja koordineerimispunktid ning pädevad asutused ja ametnikud ning antakse Vabariigi Valitsusele volitus otsustada nende määramise deklaratsiooni tegemine ja muutmine. See annab vajaduse korral paindlikuma muutmisvõimaluse, kui asutuste nimed või kontaktpunktid muutuvad. Võrreldes nn Prümi seadust ja Vabariigi Valitsuse korralduse kavandit muutub see, et Siseministeeriumi teabe- ja analüüsiosakonna asemel on edaspidi riiklik kontakt- ja koordineerimispunkt Politsei- ja Piirivalveamet (arvestades nn Prümi lepingu artikleid 19 ja 26), kes neid ülesandeid ka praktikas täidab ning Maanteeamet asendatakse Transpordiametiga (arvestades nn Prümi lepingu artikli 12 lõiget 2). Eelnimetatud Siseministeeriumi osakonda ei ole Siseministeeriumis enam aastast 2012. Samuti ei ole enam asutust nimega Maanteeamet, kuna alates 1. jaanuarist 2021 ühendati Veeteede Amet, Lennuamet ja Maanteeamet Transpordiametiks.
