Summary
28. novembril 2018. aastal võeti vastu Euroopa Parlamendi ja nõukogu määrus Schengeni infosüsteemi kasutamise kohta ebaseaduslikult riigis viibivate kolmandate riikide kodanike tagasisaatmiseks ja määrus, milles käsitletakse Schengeni infosüsteemi (SIS) loomist, toimimist ja kasutamist piirikontrolli valdkonnas ning millega muudetakse Schengeni lepingu rakendamise konventsiooni ja määrust. Määrustega kohustatakse liikmesriike sisestama SIS-i hoiatusteade iga kord, kui seadusliku aluseta riigis viibivale kolmanda riigi kodanikule on tehtud tagasisaatmisotsus või tema suhtes on kohaldatud Schengeni sissesõidukeeldu. Eelnõuga viiakse väljasõidukohustuse ja sissesõidukeelu seadus, politsei ja piirivalve seadus ning riigipiiri seadus nimetatud määruste nõuetega kooskõlla. Lisaks tehakse muudatused, mis on tingitud Eestile 2018. aastal tagasisaatmise valdkonna Schengeni hindamistel tehtud märkustest. Need puudutavad eeskätt seadusliku aluseta riigis viibiva välismaalase lühiajalist kinnipidamist ning tagasi- või väljasaatmise eest vastutava riigi määramist.
