Summary
Eelnõu kohaselt lõpetatakse töötutoetuse maksmine. Edaspidi makstakse töö kaotuse korral registreeritud töötule kas sissetulekupõhist töötuskindlustushüvitist või uut eelnõuga loodavat baasmääras töötuskindlustushüvitist. Senine töötuskindlustushüvitis nimetatakse ümber sissetulekupõhiseks töötuskindlustushüvitiseks ja selle saamise tingimusi ei muudeta. Baasmääras töötuskindlustushüvitis määratakse isikule, kes on enne töötuna arvele võtmisele eelnenud 36 kuu jooksul töötanud vähemalt 8 kuud. Hüvitist makstakse kuni 180 päeva ja hüvitise suurus on kõigile sama, 50% eelneva kalendriaasta töötasu alammäärast (2024. a oleks hüvitise suurus 374,50 eurot kuus). Inimesed, kes nendele nõuetele ei vasta, saavad KOVilt taotleda toimetulekutoetust. Prognoosi kohaselt kasvavad seaduse rakendamisel kulud 2026. aastal 2,3 miljoni euro võrra, sest samaaegselt makstakse enne 2026. aastal määratud töötutoetusi ja uue süsteemi järgi määratud baasmääras töötuskindlustushüvitist. Aastatel 2027 ja 2028 tekib kulude kokkuhoid, vastavalt ca 23,2 ja ca 25,3 miljonit eurot. Muudatused jõustuvad 1. jaanuaril 2026. Lisaks lahendatakse õiguskantsleri tõstatatud probleem, et kehtiv kord lubab kuni 24-aastasele perest eraldi elavale õppurile maksta toimetulekutoetust üksnes juhul, kui tema perekonnale määrati toimetulekutoetus eelmisel või jooksval kuul. Samuti nähakse ette võimalus maksta erandina toimetulekutoetust kuni 24-aastastele perest eraldi elavatele õpilastele ja üliõpilastele, kui nende suhted pereliikmetega on katkenud või vanematel puudub võimekus oma lapsi toetada. Menetluse käigus tegi sotsiaalkomisjon muudatusettepaneku, millega viiakse töövõimetoetuse seadus põhiseadusega kooskõlla. 2024. aasta 6. juunil toimus täiskogus õiguskantsleri ettepaneku arutelu, täiskogu toetas õiguskantsleri ettepanekut ning sotsiaalkomisjon sai ülesande algatada eelnõu töövõimetoetuse seaduse põhiseadusega kooskõlla viimiseks. Muudatusettepanekuga lisatakse töövõimetoetuse suuruse arvutamise erandite hulka võimalus hõlmata ka olukord, kus isikule makstakse ühes kalendrikuus välja nii eelmise kuu töötasu kui ka töölepingu või teenistussuhte lõppemisel samal kuul teenitud töötasu, mis oleks tavapäraselt (st kui töölepingut või teenistussuhet ei oleks lõpetatud) makstud välja järgmisel kuul. Inimene saab taotleda töövõimetoetuse ümberarvutamist juhul, kui tõendab töötukassale, et tema sissetulekud ületavad 90-kordset päevamäära seetõttu, et talle on ühes kalendrikuus makstud nii eelmise kuu töötasu kui ka töölepingu lõppemise tõttu samal kuul teenitud, kuid veel maksmata töötasu. Töövõimetoetuse ümberarvutamiseks tuleb esitada töötukassale avaldus ja tööandja tõend, kus on näha saadud tasud ja tasude liik, ning väljavõtte töölepingust, kus on näha kokkulepitud töötasu saamise aeg.
