Summary
Eelnõu loob aluse riigi osalemiseks eraüldhariduskoolide tegevuskulude katmiseks. Eelnõuga tagatakse erakoolidele tegevustoetus kohaliku omavalitsuse üksuste keskmisel tasemel ja luuakse jätkusuutlik erakoolide rahastamise kava 2020+. Eelnõu ei puuduta eraüldhariduskooli pidajatele riigieelarvest eraldatava haridustoetuse andmise printsiipe õpetajate, direktorite ja õppealajuhatajate tööjõukulude, samuti muude kooli õppekava täitmiseks ja kooli pidamiseks vajalike kulude osas. Samuti on jätkuvalt kohaliku omavalitsuse üksusel õigus vabatahtlikult eraüldhariduskoolide pidajaid tegevuskulude katmisel toetada. Eelnõu järgi on toetust tegevuskulude katmiseks riigieelarvest võimalik eraüldhariduskoolil taotleda, kui on täidetud järgmised nõuded: kool on tegutsenud vähemalt neli aastat ja kooli tegutsemiseks on antud tähtajatu tegevusluba vähemalt ühe kooliastme osas; koolis ei ole õppemaksu või õppemaks ei ole ühegi õpilase jaoks kuus suurem kui 25 protsenti töötasu alammäärast; kooli tegevusest saadud kasum investeeritakse õppe- ja kasvatustegevusse, sealhulgas õpikeskkonda; kooli eelarve ja hariduskulud on avalikud; koolil puudub maksuvõlg riigi ees või on maksuvõla tasumine ajatatud ning kohaliku omavalitsuse üksus, mille haldusterritooriumil erakool tegutseb, on andnud nõusoleku tegevuskulutoetuse eraldamiseks. Nimetatud nõuete täitmisel saab eelnõu järgi toetust taotleda alates 2018. a 1. jaanuarist. Toetuse arvutamise aluseks on õpilaste arv 10. novembri seisuga ja selle kohaliku omavalitsuse üksuse, mille haldusterritooriumil eraüldhariduskool tegutseb, üldhariduskooli õppekoha keskmine tegevuskulu, kuid mitte rohkem kui põhikooli- ja gümnaasiumiseaduse alusel kehtestatud piirmäär. Toetust ei eraldata nõuete mittetäitmisel või kui Haridus- ja Teadusministeeriumil on tekkinud kahtlus, et erakooli asutamisega asendatakse kohaliku omavalitsuse kohustust võimaldada oma haldusterritooriumil elavatele õpilastele hariduse kättesaadavus. Kui kohalik omavalitsus, mille haldusterritooriumil erakool tegutseb, ei ole andnud nõusolekut tegevuskulutoetuse eraldamiseks, on Haridus- ja Teadusministeeriumil õigus erandkorras toetus siiski määrata juhul, kui see on vajalik hariduse mitmekesisuse tagamiseks. Samuti on valdkonna eest vastutaval ministril õigus toetus tagasi nõuda, kui toetust on eraldatud ebaõigete andmete alusel. Kehtiva erakooliseaduse kohaselt eraldatakse eraüldhariduskoolidele tegevuskulude toetust 2019. aasta 31. detsembrini. Toetuse suurus on 75 protsenti selle kohaliku omavalitsuse üksuse, mille haldusterritooriumil eraüldhariduskool tegutseb, üldhariduskooli keskmisest tegevuskulust 2016. aastal. Eelnõu kohaselt jääb senine regulatsioon kehtima, samuti nähakse ette üleminekusätted neljaaastase tegutsemisnõude, tähtajatu tegevusloa, kohaliku omavalitsuse nõusoleku nõude ning õppemaksu lae kohaldamiseks.
