Summary
Eelnõuga võetakse üle ELi vastav direktiiv läbipaistvate ja prognoositavate töötingimuste kohta Euroopa Liidus, mis näeb ette töötaja suhtes kohaldatavate töötingimustega seotud miinimumnõuded, et tagada töötingimuste piisav läbipaistvus ja prognoositavus. Kavandatud muudatused suurendavad nii töötajate kui ka ametnike kaitset töö- või teenistussuhtes ning aitavad tagada, et neid teavitatakse olulistest töö- ja teenistustingimustest töö- või teenistussuhte võimalikult varajases faasis. Töölepingu seaduses täiendatakse nende andmete hulka, millest tööandja peab töötajat tööle asumisel kirjalikult teavitama. Tööandjal tekib kohustus teavitada töötajat tööandja pakutavast koolitusest, hüvitatavast puhkusest, katseaja kestusest, ületunnitöö tegemise ja hüvitamise korrast, töölepingu ülesütlemise vormist ja põhjendamiskohustusest, samuti maksusid ja makseid saavatest asutustest ning nende maksmisega kaasnevast kaitsest. Andmete muutmise korral tuleb teave muudatuse kohta esitada hiljemalt muudatuse jõustumise päeval. Samuti nähakse ette, et töö tegemise takistuse korral pikeneb katseaeg võrdeliselt eemal viibitud ajaga, näiteks ajutise töövõimetuse korral. Töötajale antakse õigus taotleda sobivaid töötingimusi, näiteks taotleda osalise tööaja asemel täistööajaga töötamist ja saada tööandjalt taotlusele vastus. Lisaks nähakse ette kaitse ebasoodsa kohtlemise eest juhuks, kui töötaja toetub oma õigustele või juhib tähelepanu nende rikkumisele. See tähendab, et töötajale ei tohi õiguste eest seismise tõttu järgneda negatiivseid tagajärgi, näiteks kui töötaja pöörab tähelepanu, et tööandja ei taga töö- ja puhkeajanõudeid, ei tohi tööandja rakendada töötaja suhtes ebasoodsaid tagajärgi. Eelnõuga muudetakse ka avaliku teenistuse seadust ja täiendatakse samuti andmete hulka, mida tuleb ametiasutuse töökorralduslikes aktides ja palgajuhendis ametnikule esitada. Ka nähakse Eestisse lähetatud töötajate töötingimuste seaduses ette teabe hulk, millest tööandja peab Eestisse lähetatud töötajat pikema kui ühe kuulise lähetuse korral kirjalikult teavitama, näiteks teave tasu suuruse ja vääringu, riigist tagasipöördumise kohta. Töötervishoiu ja tööohutuse seadust täiendatakse töötaja kohustusega tagada, et töötamine või teenuse osutamine teise tööd andva isiku juures ei ohusta tema enda ega teiste elu ja tervist. Täiendus on oluline, et juhtida töötaja tervisekaitse eesmärgil tähelepanu töö- ja puhkeaja nõuete täitmise olulisusele.
