Summary
Eelnõuga luuakse patsiendikindlustuse ja vaktsiinikahjude hüvitamise süsteemid. Eelnõuga kehtestatakse patsiendikindlustus, mis kujutab endast tervishoiuteenuse osutajate (TTO) kohustuslikku vastutuskindlustust. Eelnõuga sätestatakse TTO kohustusliku vastutuskindlustuse põhimõtted ja korraldus, samuti patsiendile hüvitamisele kuuluva kahju alused ja ulatus. Uue süsteemi loomise eesmärk on patsiendi parem kaitse ja senisest lihtsam hüvitise taotlemine. Kahjujuhtumi korral, kus patsiendi ravimisel oleks tervisekahju olnud võimalik vältida, hakkab nõude asjaolusid hindama kindlustusandja. Kindlustussumma kahju kannatanud patsiendi kohta on kuni 100 000 eurot, kogu üheaastase kindlustusperioodi kohta 3 miljonit eurot. Eelnõuga kehtestatakse muu hulgas ka miinimumnõuded patsiendiohutuse korraldusele, seal hulgas luuakse teabe analüüsi süsteem, et ennetada ohu- ja kahjujuhtumeid. Plaani järgi rakendub patsiendikindlustuse süsteem 1. juulist 2024. Teiseks muudetakse eelnõuga ravimiseadust ja nähakse ette vaktsiinikahjude sundkindlustus ehk vaktsiinikindlustus. Vaktsiinikindlustuse eesmärk on lihtsustatud korras hüvitada inimestele vaktsineerimise tagajärjel tekkinud raske tervisekahjustus. Seda juhul, kui tõenäoliselt vaktsineerimise tagajärjel on patsiendil tekkinud raske tervisekahjustus, mis kestab vähemalt neli kuud. Hüvitis on ette nähtud ka juhul kui tõenäoliselt vaktsineerimise tagajärjel inimene sureb. Regulatsiooniga luuakse inimesele, kes on saanud vaktsineerimise järgselt rasket tervisekahju, võimalus nõuda kahju hüvitamist seaduses kehtestatud määras sõltuvalt kahju raskusastmest. Vaktsiinikindlustusega kehtestatakse vaktsiinide turustajale kindlustusmakse kohustus, mille suurus sõltub Eestis kasutamiseks turustatud dooside arvust ja valitsuse kehtestatud maksemäärast. Kindlustusmaksetest kaetakse hüvitiste maksmise ja menetlemise kulud nii Haigekassa kui Ravimiameti poolt. Vaktsiinikindlustuse reeglid on kavandatud jõustuma 1. maist 2022. 2022. aastal hüvitatakse tagasiulatuvalt COVID-vaktsiinide põhjustatud kahjujuhtumid. 2023. aastast laieneb süsteem ka muudele vaktsiinidele, sealhulgas immuniseerimiskava vaktsiinidele, gripi, puukentsefaliidi ja nn reisivaktsiinidele. Põhjuslikku seost tervisekahju ja vaktsineerimise vahel peab hakkama hindama Ravimiamet, kes on teinud seda ka praegu, kuid mitte sellisel eesmärgil ja mahus. Taotluste hulka prognoosida on keeruline, kuid arvatavalt tõstab hüvitise saamise võimalus pöördumiste arvu. Seletuskirjas märgitakse, et Eestis algas Covid-19 vastu vaktsineerimine 27. detsembril 2020. Sellest kuupäevast alates on Ravimiametile teatatud vaktsiinidega võimalikest kõrvaltoimetest 6405 (31.12.21 seisuga) korral. Vaktsineerimisega tõenäoliselt seotud tõsist kõrvaltoimet on detsembri alguse seisuga tuvastatud 237-l korral ja surma neljal korral. Vaktsiinikahjude hüvitiste kulu on 2022. aastal prognoositud 1 miljon eurot, süsteemi haldamise ja IT kuludega kokku 1,4 miljonit eurot. Alates 2023. aastast kaetakse süsteemi kulud kindlustusmaksetest. Kolmandaks luuakse ravikindlustuse seaduses võimalus lisada haiguste loetellu lisaks hinnakokkuleppe või piirhinna olemasolul ka selliseid haigusi, mille ravimiseks kasutatavate ravimite hind kujuneb Euroopa Komisjoni ravimite ühishankes. Haigekassal tekib võimalus inimesele ravimite hüvitamisel arvestada Euroopa Komisjoni ravimite ühishankes kujunenud ravimi hinda. Tegemist on tehniliste muudatustega, kuid need on olulised ravimite hüvitamise õigusselguse tagamiseks. Muudatus puudutab lähiajal turule saabuvaid COVID-19 retseptiravimeid, mis on mõeldud koduses ravis kasutamiseks. Need muudatused jõustuvad eelnõu kohaselt 1. maist 2022.
