Summary
Montreali protokolli reguleerimisalasse lisatakse fluorosüsivesinikud (HFC). Muudatuse olulisemaks eesmärgiks on HFC-de kasutamise järk-järguline piiramine ning seeläbi globaalse kliimasoojenemise vähendamine. Nimetatud aineid kasutatakse peamiselt konditsioneerides külmutus- ja jahutussektoris, aerosoolides, tulekustutussüsteemides ning vahutootmises. Seletuskirjas märgitakse, et osoonikihti kahandavate ainete kasutamise piiramine on olnud globaalne eesmärk juba rohkem kui 30 aastat. 22. märtsil 1985 sõlmiti osoonikihi kaitsmise Viini konventsioon ning 16. septembril 1987 sõlmiti osoonikihti kahandavate ainete Montreali protokoll. Eesti ühines Viini konventsiooni ja Montreali protokolliga 11. septembril 1996 vastu võetud seadusega. Viini konventsioonil ja Montreali protokollil on 197 osalisriiki. Viini konventsiooni peamiseks eesmärgiks on inimeste tervise ja looduskeskkonna kaitsmine osoonikihi kahanemisega seotud kahjulike mõjude eest. Montreali protokolli peamiseks eesmärgiks on osoonikihti kahandavate ainete kasutamise piiramine, seades lõppeesmärgiks nende ainete täieliku kasutusest kõrvaldamise. Kigali muudatus sisaldab meetmeid HFC heitkoguste vähendamiseks ja see aitab rakendada Pariisi kokkulepet, eelkõige hoida üleilmne temperatuuri tõus tunduvalt alla 2 °C võrreldes industriaalühiskonna eelse tasemega ning jätkata jõupingutusi, et piirata temperatuuri tõusu veelgi, et see jääks 1,5 °C piiresse võrreldes industriaalühiskonna eelse tasemega. Kigali muudatus võimaldab 21. sajandi lõpuks ära hoida ülemaailmse õhutemperatuuri tõusu hinnanguliselt 0,5 kraadi võrra. Seega on Kigali muudatusel oluline positiivne mõju loodus-ja elukeskkonnale. Kigali muudatus võeti vastu Montreali protokolli osaliste 28. kohtumisel, mis toimus 10.–15. oktoobrini 2016 Rwandas Kigalis. Muudatuse ratifitseerimisega ei kaasne Eesti õiguse muutmise vajadust sest ELis reguleerib HFC-sid otsekohalduv vastav määrus. Muudatus toob kaasa Montreali protokolli liikmemaksu suurenemise seniselt 80 838 USD hinnanguliselt kuni 187 000 USD.
