Summary
Eelnõuga muudetakse konkursside regulatsioon ametiasutusele vähem bürokraatlikuks ja ametnikele lihtsamaks, võimaldades ajutiselt äraoleva ametniku asendajal jätkata ametikohal ilma konkurssi läbimata olukorras, kui asendatav ei naase. Samuti muutub paindlikumaks ja vähem bürokraatlikuks värbamine ametikohale, millele oluliselt sarnasele ametikohale on konkurss alles toimunud ning millel osalesid tugevad kandidaadid, kellele võib teha 150 kalendripäeva jooksul alates konkursi väljakuulutamisest ettepaneku asuda ametikohale ilma konkursita. Eelnõuga muudetakse paindlikumaks ajutise üleviimise regulatsioon ja nähakse ette võimalus ametniku osaliseks tähtajaliseks üleviimiseks. Kehtiv seadus seda ei võimalda, sest ametniku tähtajalisel üleviimisel peatub ametniku avaliku võimu teostamise õigus ametikohal, millelt ametnik üle viidi. Töötuskindlustuse seaduse muudatuse kohaselt võrdsustatakse ametnike ja töötajate õigused olukorras, kus ametnik on õigusvastaselt teenistusest vabastatud ning ta soovib saada töötuskindlustuse hüvitist. Kehtiva korra kohaselt ei ole ametnikel õigusvastaselt teenistusest vabastamise korral töötuskindlustushüvitisele õigust. Lisaks näeb eelnõu ette, et kui ametnik hukub või sureb teenistusülesannete täitmise ajal välisriigis, korraldab välisministeerium riigi kulul põrmu toomise Eestisse, kui sellise kulutuse hüvitamine ei ole kindlustuslepingus ette nähtud. Muudatused tulenevad sellest, et avaliku teenistuse seadus jõustus 1. aprillil 2013 ning seaduse rakendamisel on üheks enim kriitikat saanud teemaks konkursid.
