Summary
Eelnõuga luuakse vanema kaotanud lastele uus ühtne toitjakaotustoetuse skeem, mis tagab igakuise toetuse, sõltumata surnud vanema pensionistaažist või laste arvust. Seletuskirjas märgitakse, et praeguste reeglite järgi on lastele makstav toitjakaotuspension erineva suurusega ega kata paljudel juhtudel piisaval määral laste ülalpidamiskulusid. Eriti haavatavas olukorras on lasterikkad pered. Uueks toetuse alussummaks on 272 eurot, mida indekseeritakse igal aastal vastavalt elukalliduse tõusule ehk praeguste prognooside järgi oleks väljamakstav toetuse suurus on 2026. aastal ligikaudu 345 eurot. Loodav toitjakaotustoetus vähendab oluliselt vaesusriski ühe vanemaga leibkondades ja toetab lasterikkaid peresid. Toitja kaotanud lapse vajadused on samasugused sõltumata sellest, kui kaua vanem jõudis enne surma töötada. Ühtlane ja indekseeritud toetus parandab lapse heaolu ja tagab pikaajalise kindlustunde. Senine lastele mõeldud toitjakaotuspensioni skeem asendatakse 2026. aasta 1. oktoobrist uue perehüvitiste seaduse alusel loodud toetusega. Toitjakaotustoetust makstakse kuni lapse 19-aastaseks saamiseni või õpingute jätkumisel kuni 21-aastaseks saamiseni. Lastele, kes eelnõu jõustumisel juba saavad toitjakaotuspensioni ja kelle toitjakaotuspension oli väiksem või sama suur kui toitjakaotustoetus, saavad edaspidi toitjakaotustoetuse suuruses toetust. Juhul kui määratud toitjakaotuspension oli suurem toitjakaotustoetuse summast, saavad edaspidi toitjakaotuspensioni suuruses toetust, kuni see võrdsustub toitjakaotustoetuse suurusega. Loodava toetuse suurus võtab arvesse lapse ülalpidamiskulusid, tarbijahinnaindeksi muutust ja Eesti keskmise brutokuupalga muutust – iga-aastase indekseerimise tulemusena säilib toetuse reaalväärtus ajas. Toetuse saamist võimaldavate õppeasutuste ring on laiem kui toitjakaotuspensionil, samuti on võimalik saada toitjakaotustoetust samal ajal töövõimetoetusega. Toitjakaotustoetus tagab 90%le saajatele senisest suurema toe. Uusi toitjakaotuspensione riikliku pensionikindlustuse seaduse alusel 1. oktoobrist 2026. aastast 21-aastastele ja vanematele enam ei määrata (v.a. eriseaduste alusel toitjakaotuspensionid). 24-aastastele ja vanematele inimestele, kel tekkis õigus toitjakaotus- või rahvapensionile enne 2026. aasta 1. oktoobrit, jätkatakse pensioni maksmist kuni varem määratud tähtajani (nt kui maksmine on seotud töövõime kaoga, siis selle perioodi lõpuni). Lapseootel naistel, kes ei tööta, ja kelle lapse teine vanem on surnud, tekib võimalus saada vanemahüvitist 70 kalendripäeva enne lapse eeldatavat sünnikuupäeva.
