Summary
Eelnõuga kehtestatakse uue teadus- ja arendustegevuse korralduse seaduse terviktekst, millega nähakse ette teadus- ja arendustegevuse ning innovatsiooni (TAI) riiklik korraldus ja osapoolte ülesanded, kvaliteedi tagamise, rahastamise ning järelevalve alused. Eelnõuga reguleeritakse seaduses teadus- ja arendustegevuse kõrval ka teadus- ja tehnoloogilisel arendustegevusel põhinevat innovatsiooni. Sellest tulenevalt täpsustatakse ministeeriumide ja nõuandvate kogude ülesandeid ja nimetusi, näiteks senine TAN nimetatakse ümber Teadus- ja Arendustegevuse ning Innovatsiooni Poliitika Nõukoguks (TAIP). Riigikantseleile antakse ülesanne koordineerida avaliku sektori innovatsioonialaseid tegevusi. Samuti täpsustatakse ministeeriumide ülesandeid oma valitsemisala teadus- ja arendustegevuse ning innovatsioonitegevuste planeerimisel, korraldamisel ja rahastamisel ning vastava info edastamisel Haridus- ja Teadusministeeriumile. Uuringutega seotud teave peab kajastuma Eesti Teadusinfosüsteemis. Uue osapoolena teadus- ja arendustegevuse riiklikul korraldamisel sätestatakse seaduses rakendusuuringute keskus. Uue ülesandena lisandub Haridus- ja Teadusministeeriumile vastutus teaduseetika süsteemi toimimise tagamiseks. Selleks saab Eesti Teadusagentuur ülesande moodustada teaduseetika komitee ja komisjoni teaduseetika rikkumiste menetlemiseks. Teadus- ja arendusasutused ning kõrgkoolid saavad edaspidi saata uuringud teaduseetika komiteesse hinnanguteks või luua oma eetikakomitee. Teaduseetika komitee on oma töös ja otsustes sõltumatu. Täidesaatva riigivõimu poolt tellitavate poliitikanalüüside ja -uuringute andmekaitsealaseid ja eetilisi aspekte hindab Isikuandmete kaitse seaduse muudatuse kohaselt Andmekaitse Inspektsioon, kes konsulteerib selleks vajadusel loodava teaduseetika komiteega. TA asutuse kvaliteedihindamise protseduur jääb üldjoontes samaks. Eelnõus on välja toodud rahastusviisid, mille kaudu toetatakse teadus- ja arendustegevust ning innovatsiooni. Muudetakse senist süsteemi, kus teadus- ja arendusasutusi rahastati baasfinantseerimise kaudu. Uue süsteemi järgi jaguneb asutuste rahastus kaheks osaks: baasrahastus ja tulemusrahastus. Baasrahastuse määramisel arvestatakse asutuse viimase kolme aasta rahastust, tulemusrahastuse puhul aga asutuse tulemusi. Äriühingutena tegutsevate teadus- ja arendusasutuste rahastus hakkab edaspidi tulema Majandus- ja Kommunikatsiooniministeeriumi eelarvest. Toetuste täpsemad tingimused kehtestatakse eraldi rakendusaktidega, kuid ministeeriumitel jääb võimalus kasutada teadus- ja arendustegevust ning innovatsiooni rahastamiseks ka muid õigusaktides ettenähtud võimalusi.
