Summary
Kokkuleppe alusel saab Luksemburgi riiklikku andmekeskusesse majutada Eesti riigi järjepidevuse tagamiseks olulised andmed ja kriitilised andmekogud, mis suurendab Eesti digitaalse ühiskonna turvalisust ja andmete majutamise kvaliteeti. Seletuskirjas märgitakse, et andmete ja infosüsteemide majutamisel on valitud partneriks Luksemburg, kus on olemas riigile kuuluvad kõrgturvalised andmekeskused, mis on sertifitseeritud Tier 4 tasemel. Selliseid Eestis ei leidu. Samuti on Luksemburg valmis tagama Eesti andmete ja infosüsteemide puutumatust. Lisaks on Luksemburg digitaalselt arenenud infoühiskond, kellega on tulemuslik teha digitaalsete teenuste vallas koostööd ning samuti on Luksemburgil olemas väga head andmesideühendused. „Andmesaatkond“ on riigipilve lahendus, mille kaudu on võimalik andmeid ja teenuseid hoiustada ning vajaduse korral käitada turvalisest andmekeskusest väljaspool riigi territoriaalseid piire. See võimaldab jätkata Eesti riigi toimimist ka tingimustes, kus riigi territooriumil asuvate andmekeskuste töö on peatunud või häiritud. Kontseptsioon tervikuna on uudne ning selliseid riiklikke andmete majutamise süsteeme pole teadaolevalt veel kasutusele võetud. Tegemist pole diplomaatilise esindusega, millele kohaldatakse samasuguseid eesõigusi ja puutumatust nagu saatkondadele. Sellest tulenevalt on vaja sõlmida kokkulepe, mille eesmärgiks oleks kaitsta Eesti riigi kriitiliste andmete ja infosüsteemide puutumatust. Riikidevaheline kokkulepe määrab kindlaks riikide kohustused ja õigused, mis on vajalikud Eesti riigi andmete ja infosüsteemide kaitsmiseks. Tegemist on uudse lahendusega rahvusvahelises suhtluses ning selle kokkuleppe sõlmimisega luuakse pretsedent ka rahvusvahelises õiguses. Nimetatud kokkuleppele kirjutasid peaminister Jüri Ratas ja Luksemburgi peaminister Xavier Bettel alla 20. juunil 2017 Luxembourgis. Dokument vajab ratifitseerimist Riigikogus.
