Summary
Eelnõuga luuakse õiguslikud alused Politsei- ja Piirivalveameti (PPA) laevade üleandmiseks Kaitseväe koosseisu alates 1. jaanuarist 2023. Muudatuse kohaselt hakkab Kaitsevägi vastutama mereolukorrateadlikkuse loomise, merepiiri valvamise ning merereostuse avastamise ja likvideerimise eest Eesti merealal. Samuti asub Kaitsevägi vastutama mereseire eest, sealhulgas asub haldama ja käitama mereseiresüsteemi, tagades muu hulgas teenuse kättesaadavuse ka riigisisestele partneritele (nt PPA, Transpordiamet). Kuigi merepääste jääb jätkuvalt PPA ülesandeks (st PPA juhib seda), osaleb Kaitsevägi merel otsingu- ja päästetöödel üleantavate laevadega. Lisaks hakkab kaitsevägi teostama riiklikku järelevalvet territoriaalmeres väikelaevade, alla 12-meetrise pikkusega laevade ja jetide varustuse nõuetekohasuse üle, osutama mereabi teenust, lahendama hädaolukordi merel ning osutama ametiabi teistele asutustele, viimast eelkõige navigatsioonivälisel ajal. Merepiiri valvamiseks ning meresõiduohutuse tagamiseks antakse Kaitseväele korrakaitselised volitused ja vahetu sunni kasutamise õigus. Korrakaitselised volitused esmaste toimingute tegemiseks antakse Kaitseväele ka inimese elu ja tervist ähvardava ohu korral sekkumiseks väikesaartel ja merealal. Reformi eesmärk on parandada Eesti merealal olukorrateadlikkust ja reageerimisvõimet, sealhulgas lihtsustada käsuahelat, et tagada Eesti iseseisev kaitsevõime ning eeldused liitlaste reageerimiseks regioonis toimuvale konfliktile. PPA laevade konsolideerimine Kaitseväe koosseisu tagab tänaste laevadega parema riigikaitseliste ülesannete täitmise nii rahuajal kui ohuolukorras. Ohuolukorra ajal on üleantavatel laevadel nii julgeoleku- kui tsiviilroll.
