Summary
Eelnõuga antakse valitsusele õigus kaalutlusotsusega kodakondsus ära võtta naturalisatsiooni korras Eesti kodakondsuse saanud inimeselt, kui ta astub välisriigi riigi- või sõjaväeteenistusse või militaarsesse organisatsiooni. Kodakondsus võetakse ära, kui sellise teenistusega kaasneb oht avalikule korrale või riigi julgeolekule. Ukraina sõja kontekstis tähendab see näiteks kodakondsuse äravõtmist isikutelt, kes lähevad sõdima Vene poolele. Valitsus saab õiguse mitte ära võtta Eesti kodakondsust, kui inimese teenistus välisriigis Eesti julgeolekut ei ohusta, näiteks kui inimene läheb sõtta Ukraina poolele, et kaitsta Ukraina riigi territoriaalset terviklikkust, suveräänsust ja sõltumatust. Samas Eesti riik ei soovita, et Eesti kodanikud läheksid ühegi välisriigi eest sõdima, kuna riik ei saa tagada Eesti kodanike kaitset sõjaliste konfliktide piirkonnas. Valitsus saab naturalisatsiooni korras Eesti kodakondsuse saanud inimeselt selle talt ära võtta ka juhul, kui inimene on süüdi mõistetud inimsusevastastes või agressioonikuritegudes. Eelnõu on seotud Riigikogu menetluses oleva karistusseadustiku, kriminaalmenetluse seadustiku ja väärteomenetluse seadustiku muutmise seaduse eelnõuga (576 SE), ehk eelnõuga, mis puudutab karistusi agressiooni toetamise ja sellega seonduva vaenutegevuse eest.
