Summary
Seaduse eesmärk on ühineda Montreali 2014 protokolliga tehtavate muudatustega, millega muudetakse 1963. aastal Tokyos allakirjutatud konventsiooni. Protokolliga ühinemine võimaldab Eestil tulevikus tõhustada konventsiooni rakendamist. Täna on raskendatud näiteks menetluse alustamine korda rikkuva reisija suhtes olukorras, kus õhusõiduki registreerinud riik on näiteks Läti, lendu alustati aga Hispaaniast ning õhusõiduk koos korda rikkunud reisijaga maandub Tallinnas. Seda põhjusel, et kohalduvad õhusõiduki riikkondsust puudutavad piirangud. Rahvusvahelise Lennutranspordi Assotsiatsiooni statistika kohaselt jäävad 60% taolistest juhtumitest menetlemata. Samal ajal kui korda rikkuvatest ja häirivatest reisijatest teatatud vahejuhtumite arv õhusõidukite pardal on kasvanud. Seetõttu on oluline tagada õigusraamistik ja sõnakuulmatute reisijate vastutusele võtmise võimalus. Protokolliga ühinedes toetab Eesti arusaama, et personalil peab olema õigus tegeleda teo toime pannud reisijaga lennu ajal õhusõiduki pardal ning sõltuvalt olukorrast andma reisija üle sihtkoha riigi ametivõimudele edasiseks menetlemiseks.
