Summary
ILO on rahvusvaheline organisatsioon, kuhu Eesti kuulub ja mille eesmärgid on tööstandardite ja tööalaste aluspõhimõtete edendamine, inimväärse töö tagamine ning kolmepoolsuse ja sotsiaaldialoogi tugevdamine. Ratifitseeritavatel muudatustel on mitu eesmärki. Esiteks, muuta ILO haldusnõukogu liikmeskond esinduslikumaks. Haldusnõukogus ehk peamises otsustavas ILO täitevorganis liikmete arv suureneb – hetkel kuulub haldusnõukogusse 56 liiget, muudatuste järgselt 112 liiget. Praegu on tööstuslikult olulistel riikidel määratud kohad (USA, Ühendkuningriigid, Prantsusmaa, Saksamaa, Itaalia, India, Jaapan, Hiina, Brasiilia, Venemaa) mis kuuluvad alati ILO haldusnõukogusse. Muudatuste jõustumisel määratud kohad kaovad, tagades nõukogus suurema esinduslikkuse ja võimaldades senisest rohkematel riikidel osaleda haldusnõukogu töös. Nähakse ette põhimõte, et haldusnõukogu koosseis peab olema piisavalt esinduslik, arvestades valitsuste, töötajate ja tööandjate esindajate erinevaid geograafilisi, majanduslikke ja sotsiaalseid huve. Teiseks, muudetakse ILO peadirektori ametisse nimetamise protsess liikmeid rohkem kaasavamaks. Muudatuste kohaselt nimetab peadirektori ametisse haldusnõukogu, kes edastab otsuse heakskiitmiseks ILO peakonverentsile (s.o ILO kõrgeim otsustav kogu, mis kohtub aastas korra ja kus osalevad iga ILO liikmesriigi esindajad). Praegu on vajalik peadirektor ainult haldusnõukogu poolt ametisse nimetada. Kolmandaks, võimaldatakse ILO põhikirja olulisemaid põhimõtteid muuta senisest suurema ILO liikmete toetusega. Edaspidi nõuavad põhimõttelised muudatused (nt organisatsiooni aluspõhimõtete või peadirektori ametisse nimetamisega seotud muudatused) suuremat toetust, konverentsi 3/4 häälteenamusega ja nende jõustumiseks peavad need ratifitseerima või heaks kiitma 3/4 ILO liikmetest. Praegu kehtiva põhikirja järgi on nõutav delegaatide 2/3 häälteenamus, kui muudatused on ratifitseerinud või heaks kiitnud 2/3 organisatsiooni liikmetest ja neist viis peab olema kümnest tööstuslikult olulisest riigist. ILO põhikirja muudatused ei ole siiani jõustunud, kuna piisavalt palju riike ei ole neid ratifitseerinud. Põhikirja muudatused on ratifitseerinud 127 liikmesriiki 187-st ning need jõustuvad, kui kaks kolmandikku ILO liikmesriikidest, sh viis tööstuslikult olulist liikmesriiki, muudatused ratifitseerivad. Praegu on tööstuslikult olulistest riikidest muudatused ratifitseerinud kaks riiki: India ja Itaalia. Eestil ei ole ühtegi takistust muudatuste ratifitseerimiseks. Eelnõu omab positiivset mõju riigi välissuhetele, kuivõrd on oluline, et ILO võtab vastu otsuseid, mis on võimalikult esinduslikud ja pälvinud organisatsiooni liikmete seas laiapinnalise toetuse. ILO põhikirja muudatuste ratifitseerimise tõttu ei tehta Eesti õigusaktidesse muudatusi.
