Summary
Muudatustega korrastatakse Kaitseväe struktuuri ja selle kehtestamise tasandeid, et muuta Kaitseväe tegevus paindlikumaks ja võimaldama kiiremini reageerida uutele ülesannetele. Kaitseväe ülesehitus, struktuuriüksuste nimetused ja nende ülesanded sätestatakse edaspidi sarnaselt teiste valitsusasutustega põhimääruse tasemel. Muudatuse jõustumise järel jäävad endiselt seaduse tasemel reguleerituks Kaitseväe ülesanded ja õigused ning kohustused. Senine regulatsioon ei võimalda Kaitseväe ülesehitust operatiivselt ja paindlikult muuta. Seadusest jäetakse välja ka valitsuse kohustus kehtestada väeüksuste tüüpsuurus, ülesehitus, allüksuste nimetused, kuulumine väeliiki ja relvaliiki, samuti väeüksuste jagunemine alalises valmiduses väeüksusteks, kiirreageerimisväeüksusteks ja põhivalmiduses väeüksusteks. Sellega antakse Kaitseväe juhatajale suurem tegutsemisruum väeüksuse ülesannete täitmise korraldamisel. Samuti jäetakse kaitseväeteenistuse seadusest välja Kaitseväe struktuuriüksuste ülemate ametinimetused ja asendatakse need viitega, et tegemist on valitsuse või valdkonna eest vastutava ministri nimetatava ametikohaga. Seadus käsitleb edaspidi vaid Kaitseväe juhataja nimetamist. Kavandatava kaitseväe põhimääruse muudatuse kohaselt ei looda juurde valitsuse poolt nimetatavaid ametikohti, kuid valitsusele jäetakse võimalus neid ette näha. Kaitseminister nimetab kaitseväe juhataja asetäitja, kaitseväe peastaabi ülema, mereväe ülema, õhuväe ülema, erioperatsioonide väejuhatuse ülema, luurekeskuse ülema ja toetuse väejuhatuse ülema. Põhimääruse kavandis nähakse ette anda kaitseministrile uue õigusena nimetada küberväejuhatuse ülem ja sõjaväepolitsei ülem. Eelnõu näeb ette võimaluse kaasata reserviste rahvusvahelistel sõjalistel operatsioonidel, et suurendada kaitseväe võimekust reageerida kiiremini vahetutele ohtudele. Eelnõuga sätestatakse ka väärteokaristused kaitseväe loata mehitamata sõiduki kasutamise eest Kaitseväe territooriumil ja eelneva loata pildistamise või salvestamise eest. Kaitseväe objektid, kus on pildi või kujutise salvestamine või edastamine keelatud, on üldjuhul märgistatud keelava tähisega või tuletatakse seda meelde objektile sisenemisel. Eelnõuga muudetakse ka tegevväelase pikaajalisse lähetusse saatmise reegleid.
