Summary
Eelnõuga kehtestatakse viisa andmisest keeldumise otsuste kohtus vaidlustamise õigus. Praegu viisa andmisest keeldumise korral taotlejal kohtusse pöördumise õigust ei ole. Euroopa Kohus leidis 2017. aasta kohtuasjas, et liikmesriigid peavad ette nägema viisa andmisest keeldumise otsuste kohtus vaidlustamise menetluse. Eesti suhtes on algatatud rikkumismenetlus ja 29. jaanuaril esitas Komisjon ELi Kohtule Eesti vastu hagiavalduse. Lisaks tunnistas Riigikohus oma 22. jaanuari 2025 otsuses välismaalaste seaduse põhiseadusega vastuolus olevaks osas, milles see välistab viisa andmiseks kaebuse esitamise halduskohtule olukorras, kus taotleja viibis viisamenetluse ajal Eestis. Eelnõuga kehtestatakse senise kaheastmelise vaidemenetluse asemel kohustuslik üheastmeline vaidemenetlus ning võimaldatakse pärast seda kaevata viisaotsus ja vaideotsus halduskohtusse. Lisaks tõstetakse vaide läbivaatamise riigilõivu määr seniselt 80 eurolt 160-le.
