Summary
Eelnõuga võetakse üle ELi vastav direktiiv Euratom, millega kehtestatakse põhilised ohutusnormid kaitseks ioniseeriva kiirgusega kiiritamisest tulenevate ohtude eest. Direktiivi ülevõtmise tähtaeg oli 6. veebruar 2018. Lisanduvad nõuded radooni valdkonna reguleerimisele - antakse uus volitusnorm keskkonnaministrile tööruumide õhu radoonisisalduse viitetaseme, õhu radoonisisalduse mõõtmise korra ja tööandja kohustused kõrgendatud radooniriskiga töökohtadel kehtestamiseks. Sellega seonduvalt lisatakse vastav viide ka töötervishoiu ja tööohutuse seadusesse ning kiirgusseaduse üle järelevalve teostajate hulka lisatakse lisaks Keskkonnainspektsioonile ja Keskkonnaametile ka Tööinspektsioon. Määrusega kehtestatakse töökohtade siseruumide õhu radoonisisalduse riikliku viitetase, nõutakse õhu radoonisisalduse mõõtmist kõrgendatud radooniriskiga aladel paiknevatel töökohtadel ning teavitamist nendest töökohtadest, kus ka vaatamata kasutusele võetud radooniriski vähendamise meetmetele ületab radoonisisaldus jätkuvalt riikliku viitetaseme. Eelnõus käsitletakse kehtivast kiirgusseadusest täpsemalt looduslike kiirgusallikatega seotud inimtegevust, loetledes toimingud, mille korral tuleb töötajate ja elanike kaitseks rakendada meetmeid (nt teavitamine, kaitseabinõud, kiirgusohutushinnangud). Sellisteks toiminguteks on muu hulgas tsemendi tootmine, põhjavee puhastusjaamade käitamine ja haruldaste muldmetallide eraldamine, mille erinevate tööprotsesside käigus võivad töötajad saada tavapärasest suuremat kiirgusdoosi. Nt võivad veepuhastusjaama töötajad saada tavapärasest suuremaid kiirgusdoose filtermaterjali väljavahetamisel, kui nad puutuvad kokku sellesse puhastusprotsessi käigus kontsentreeritud kujul sadenenud radionukliididega. Kiirgusdoosi võivad saada ka elanikud, kui looduslike kiirgusallikatega seotud toimingutest pärinev materjal suunatakse eelneva radioloogilise kontrollita taaskasutusse, nt kasutatakse seda ehitusmaterjalide tootmisel. Meditsiinivaldkonnas lisandub uue teemana meditsiinikiiritusseadmete kasutamine muul kui meditsiinikiirituse rakendamise eesmärgil. Selleks võib olla nt tervise radioloogiline hindamine töölevõtmisel, sisserändel, ioniseeriva kiirguse kasutamine peidetud objektide avastamiseks inimese kehas, peidetud inimeste avastamiseks lasti läbivalgustamisel. Arvesse võetakse seda, et kiirgustegevusloa omaja peab mittemeditsiinilise kiiritamise protseduuride tegemisel tagama meditsiinikiirituse protseduuride tegemisega samaväärsete ohutusnõuete täitmise. Lisaks tehakse väikseimaid muudatusi- lisatakse termineid, täpsustatakse olemasolevaid ja siseriiklikest vajadustest liidetakse kiirgustegevuslubade, kiirgusallikate ja tuumamaterjali register keskkonnaotsuste infosüsteemiga.
