Summary
Eelnõu eesmärk on tagada kultuuripärandi säilimine ja mitmekesisus läbi ainelise ja vaimse kultuuripärandi kaitse. Eelnõu järgi soovitakse lisaks senisele arheoloogilisele leiule kaitsta ka arheoloogilist leiukohta. Eelnõu sätestab muinsuskaitse põhimõtted ning reguleerib kultuurimälestiseks, muinsuskaitsealaks ja arheoloogiliseks leiukohaks tunnistamist, nende kaitset ja säilimise korraldamist. Eelnõu tasakaalustab senisest enam ka riigi ja kultuurimälestise omaniku õigusi ja kohustusi. Selleks sätestatakse eelnõuga otsuste tegemisele suurem paindlikkus. Eelnõu näeb ette muuta Muinsuskaitseamet Kultuuripärandiametiks, kuna ameti tegevus hakkab eelnõu kohaselt hõlmama nii muinsuskaitse kui ka muuseumide valdkonda. Selline ümberkorraldus võimaldab kultuuriväärtuste valdkonda juhtida ühtselt, ühtlustada Kultuuriministeeriumi töökorraldust ning valdkonna ühiseid ressursse paindlikumalt ja efektiivsemalt kasutada. Eelnõuga vähendatakse kulusid, mida peab kultuurimälestise omanik seoses mälestisega kandma. Selleks hakatakse kultuurimälestise ja muinsuskaitsealal asuva ehitise omanikule hüvitama uuringule ja muinsuskaitselisele järelevalvele tehtud kulusid. Seni mälestise omaniku kulul toimunud muinsuskaitse eritingimuste koostamine on eelnõu järgi edaspidi Kultuuripärandiameti ülesanne.
