Summary
Eelnõuga ajakohastatakse ehitusõigust ja tehakse ehitus- ja planeerimisprotsessid lihtsamaks, kiiremaks ning paindlikumaks nii elanikele, ettevõtetele kui kohalikele omavalitsustele. Suurimad muudatused puudutavad projekteerimistingimusi. Edaspidi pole vaja muuta detailplaneeringut. Piisab vaid projekteerimistingimuste täpsustamisest, kui soovitakse krundile lisada väiksem abihoone nagu saun, kuur või garaaž. Samuti piisab projekteerimistingimuste täpsustamisest, kui soovitakse muuta rajatava hoone aluspinda või korruste arvu, täpsustada rajatise liiki, näiteks asendada elektriküte maakütte vastu, või rajada uue hoone juurde varjend. Varjendite rajamine muutub samuti lihtsamaks. Alates 2026. aasta juulist peab igal uuel hoonel olema varjend, mille lisamiseks piisab projekteerimistingimuste täpsustamisest, kui üldplaneering seda võimaldab. Eramajade ja paariselamute puhul plaanitakse loobuda kasutuslubade taotlemisest. Piisab lihtsustatud kasutusteatisest ehitisregistris, mis kajastab hoone põhiandmeid. Ehitusteatise kehtivus pikeneb neljale aastale. See tähendab, et ehitamise viibimisel ei pea kohalikku omavalitsust mitu korda teavitama. Samuti ei ole suuremate ehitusprojektide puhul mitme hoone ehitamise korral vaja esitada iga hoone kohta eraldi kasutusloa taotlust. Väiksemate, alla 20 m² mitteelamute puhul pole üldse tarvis ehitusluba ega teatist – piisab vaid projekteerimistingimuste täpsustamisest. Olulised muudatused tehakse ka vanade hoonete registris seadustamisel. Selgemaks ja õiglasemaks muutub õigusliku aluseta ehitiste registrisse kandmine, mis annab inimestele võimaluse oma kinnistud ja hooned korrektselt registrisse kanda. Enne 1. juulit 2015 ehitatud hoonete puhul on seadustamise eelduseks hoone ohutus, enne 22. juulit 1995 rajatud ehitised loetakse automaatselt õiguspärasteks. Lisaks kaob senine 500-eurone riigilõiv, mida tuli maksta seadustamata hoonete registrisse kandmisel. Puurkaevu ja -augu rajamisel kaob edaspidi kohustus asukohta eelnevalt kooskõlastada, piisab ehitusteatise ja projekti esitamisest.
