Summary
Eelnõuga viiakse seadus kooskõlla ELi vastava määrusega. Määruse eesmärk on tagada suurem läbipaistvus ja anda kodanikele ja teadlastele ligipääs kogu toiduohutust puudutavale infole, mille ettevõtja on esitanud riskihindamise protsessi käigus, v.a ärisaladusena käsitatav info. Läbipaistvuse parandamiseks vaadati üle kõik Euroopa Liidu toitu, sööta ja geneetiliselt muundatud organisme käsitlevad määrused ja direktiivid ning ühtlustati määruses ärisaladusena käsitletavad andmed. Varem olid eri õigusaktides loetletud andmed, mis võivad olla või ei tohi olla ärisaladus. Määrus muudab eelmainitud õigusakte ning edaspidi on kõigi toidu või geneetiliselt muundatud organismidega (GMO) seotud õigusaktides loetletud ainult need andmed, mida võib käsitada ärisaladusena. Kehtivas seaduses on loetletud info, mida ei tohi käsitada ärisaladusena. Muudatusega kehtestatakse loetelu andmetest, mida võib käsitada ärisaladusena. Ehk siis info hulk, mida võib käsitada ärisaladusena, muutub palju ahtamaks ja piiritletumaks. See suurendab läbipaistvust, sest kogu info, mida ei loeta ärisaladuseks, on avalikkusele kättesaadav. Seadusesse lisatakse ka nõue, et kui on olemas rahvusvahelised standardandmevormingud, siis tuleb taotluses esitada andmed sellistel andmevormidel. See lihtsustab erinevate andmete võrdlemist ning seega väheneb taotluste hindamise aeg. Samuti väheneb vajadus pärida taotlejatelt lisainfot.
