Summary
Seadust muudetakse, et viia Eesti õigus kooskõlla ELi uute määrustega, mis käsitlevad osoonikihti kahandavaid aineid ja fluoritud kasvuhoonegaase. Muu hulgas ajakohastatakse viiteid, täpsustatakse kutsete ja lubade andmise korda ning laiendatakse reguleerimisala uutele ainerühmadele, sealhulgas HFOdele ja looduslikele külmaainetele. Oluline osa muudatustest on suunatud F-gaaside kasutamise vähendamisele ja keskkonnahoiu parandamisele. F-gaasid on inimtekkelised gaasid, mis tekitavad kasvuhooneefekti – näiteks SF6 on 23 000 korda tugevam kasvuhoonegaas kui CO2. Kuna F-gaase leidub tavalistes külm- ja kliimaseadmetes ning alajaamades olevates elektrilülitites, seab seadus rangemad nõuded nende käitlemisele, kontrollile ja aruandlusele. Eesmärk on soodustada üleminekut looduslikele külmaainetele ning rohetehnoloogiale külmamajanduses. HFO-sisaldavate seadmete omanikud (praegu 14) peavad hakkama seadmeid registreerima ja tegema lekkekontrolle (100–300 eurot). Külma-, kliima- ja soojuspumpade käitajate kutsetunnistused muutuvad tähtajaliseks. Käitlemisloa kohustus laieneb ka looduslikele külmaainetele, mis mõjutab vähemalt 20 ettevõtjat. Mitmes valdkonnas vähendatakse samal ajal halduskoormust. Näiteks kaob kohustus registreerida eluhoonetesse paigaldatud suurema võimsusega soojuspumpasid (50–100 seadet), lihtsustatakse F-gaaside aruandlust ja kehtestatakse künniskogused, mis vähendavad andmete esitamise kohustust umbes 10 ettevõtjal. Muudatused on kavandatud jõustuma üldkorras ning Euroopa Komisjoni tuleb uutest karistussätetest teavitada enne 1. jaanuari 2026.
