Summary
Eelnõuga luuakse selge õiguslik alus ohjeldusmeetmete rakendamiseks olukordades, kus patsiendi psüühikahäirest või kehalisest haigusest tulenev seisund muudab ta otsusevõimetuks ja tekitab otsese ohu tema enda või teiste elule ja tervisele. Sellised olukorrad võivad tekkida vältimatu abi, kiirabi, statsionaarse eriarstiabi või statsionaarse õendusabi osutamisel, kui patsiendi käitumine ei võimalda tervishoiuteenust edasi osutada ilma kohese sekkumiseta. Praegu tohib ohjeldusmeetmeid rakendada üksnes tahtest olenematu psühhiaatrilise ravi raames, kuid praktikas on vajadus sekkuda sageli ka vabatahtlikult ravil olevate patsientide või patsientide puhul, kes viibivad väljaspool psühhiaatriaosakonda, näiteks erakorralises meditsiinis, intensiivravis või kiirabis. Sellise vajaduse võivad põhjustada näiteks joobeseisund, deliirium või muu seisund, mis muudab patsiendi käitumise ettearvamatuks ja ohtlikuks. Selge seadusliku aluse loomine on vajalik, sest ohjeldusmeetmed on intensiivne vabaduspõhiõiguse riive. Õigusraamistiku kehtestamine tagab patsientide ja tervishoiutöötajate ohutuse ning ühtlase ja kvaliteetse ravi, võimaldades vältida olukordi, kus sekkumise õiguspärasus on vaieldav. Kuigi ohjeldusmeetmete rakendamisega kaasneb tervishoiuteenuse osutajatele täiendav jälgimis- ja dokumenteerimiskohustus, vähendab uus kord halduskoormust vaidluste lahendamisel.
