Summary
Eelnõu eesmärk on võtta Eesti õigusesse üle ELi vastav direktiiv ehk nn ühtse loa direktiiv, mis reguleerib kolmandate riikide kodanike elamis- ja töötamisõigust ning tagab välistöötajate võrdse kohtlemise. Muudatused on plaanitud jõustuma 22. mail 2026, mis on direktiivi ülevõtmise tähtaeg. Edaspidi võib töötamiseks antud tähtajalise elamisloa kehtivusajal vahetada tööandjat ilma uut elamisluba taotlemata. Piisab, kui uus tööandja registreerib töökohavahetuse politsei- ja piirivalveametis, kes teeb otsuse kuni 30 päeva jooksul. Uue tööandja juures töötamisel kehtivad tavapärased töötamise nõuded, näiteks palgakriteerium ja töötukassa luba, et vältida korra väärkasutust. Muudatus vähendab oluliselt halduskoormust ja kiirendab tööandja vahetamist. Töötamiseks antud elamisloa alusel võib välistöötaja edaspidi olla tööta senise 90 päeva asemel kuni 3 või 6 kuud, sõltuvalt elamisloa kestusest: alla 2 aasta kehtinud elamisloa puhul kuni 3 kuud; vähemalt 2 aastat kehtinud elamisloa puhul kuni 6 kuud. Erandjuhtudel võib töötaolek kesta kuni 9 kuud. Lisaks laieneb töötaoleku lubatav alus ka muudele töölepingu lõppemise põhjustele, sh töötaja enda algatusel. Kui töötaolek kestab üle 3 kuu, peab välismaalane tõendama piisavate rahaliste vahendite olemasolu Eestis elamiseks. Pikaajalise viisaga töötamisel Eestis viibivatel inimestel tekib õigus mitmetele sotsiaalkindlustushüvitistele, näiteks vanemahüvitis, töövõime- ja pensionihüvitised. See tekib eeldusel et üldised kvalifitseerumistingimused on täidetud. Õigus kehtib ainult neile, kes reaalselt Eestis töötavad ja kellel on vastav viisa. Peretoetused välistöötajatele ei laiene. Välismaalaste tööle võtmise seadusrikkumiste arv on viimastel aastatel kasvanud. Kui 2021. aastal registreeriti 380 vastutusele võtmist, millest vaid ühel juhul karistati juriidilist isikut, siis 2024. aastal tuvastati juba 524 rikkumist ning juriidilisi isikuid võeti vastutusele 38 korral. Kehtivad trahvimäärad pärinevad 2010. aastast ja on ajale jalgu jäänud ega täida karistusõiguslikku eesmärki. Mõne rikkumise eest on juriidilise isiku maksimaalne trahv 3200 eurot, mis ei ole paljudele ettevõtetele tegelik heidutus. Seoses sellega tõstetakse juriidiliste isikute trahvimäärasid, seades maksimaalseks trahviks oluliste rikkumiste korral 100 000 eurot. Eesmärk on suurendada sanktsioonide mõjusust ja ennetada rikkumisi.
