Summary
Eelnõuga viiakse riigisisene õigus kooskõlla Euroopa Liidu uuendatud õhukvaliteedi raamistikuga, vähendatakse väiksema keskkonnamõjuga ettevõtete halduskoormust ja Keskkonnaameti töökoormust. Eelnõu koosneb neljast paragrahvist, millest esimesega muudetakse ja täiendatakse atmosfääriõhu kaitse seaduse kehtivaid sätteid, teise paragrahviga täiendatakse keskkonnatasude seadust, kolmanda paragrahviga täiendatakse riigilõivuseadust ning neljandas paragrahvis sätestatakse seaduse jõustumise aeg. ELi direktiiviga kehtestatakse senisest rangemad õhukvaliteedi piirväärtused ning täpsustatakse nõudeid õhukvaliteedi seirele, andmete kättesaadavusele ja avalikkuse teavitamisele. Eelnõu rakendamine aitab parandada Eesti elanike elukeskkonda, vähendada saastest tingitud tervisekahjusid ning täita Euroopa Liidu kliima- ja keskkonnaeesmärke. Eelnõu toob peamiselt kaasa uued nõuded riigile ning vähemal määral kohalikele omavalitsustele. Eelnõu võib tuua kaasa halduskoormuse suurenemise teatud ettevõtjate jaoks. Alates 2030. peavad käitajad järgima uusi õhukvaliteedi piirväärtusi, mistõttu tuleb ettevõtetel hinnata oma tegevuse vastavust õhukvaliteedi uutele piirväärtustele ja vajadusel rakendada meetmeid nende tagamiseks. Seaduse muudatused puudutavad kohalike omavalitsuste rolli õhukvaliteedi parandamisel. Kui õhukvaliteedi piir- või sihtväärtused on ületatud või on oht nende ületamiseks, peab kohalik omavalitsus koostama õhukvaliteedi parandamise kava või tegevuskava ja kaasama sellesse ka heiteallikate käitajad. Seire ja andmete avalikustamiseks nähakse ette õhukvaliteedi indeks, mis põhineb Euroopa Keskkonnaameti metoodikal ja mida uuendatakse kord tunnis. Kuna olemasolevatele 1– 5 MWth põletusseadmetele hakkavad kehtima rangemad õhusaaste piirväärtused, toob see 449 katlamajale kaasa vajaduse muuta õhusaasteluba. Seoses sellega tehakse bürokraatiat vähendav muudatus, mis lubab väikestel katlamajadel minna õhusaasteloa taotlemiselt üle lihtsale registreeringule.
