Summary
Muudatuste eesmärk on parandada prokuratuuri sisest kontrolli ning vastutust riikliku süüdistuse esitamisel, ajakohastada ning muuta paindlikumaks prokuratuuri töökorraldust, tagada riigi peaprokurörile paremad võimalused prokuröride kvalifikatsiooni ja professionaalsuse tõstmiseks ning muuta juhtimis- ja karjäärisüsteem läbipaistvamaks. Eelnõuga piiratakse prokuröride kassatsioonide esitamise õigust ning suurendatakse juhtivprokuröri ning riigi peaprokuröri vastustust, kohustades neid hindama kassatsiooni esitamise põhjendatust ning sellele oma heakskiidu andma. Samuti lihtsustatakse tingimusi kriminaalasja menetluse üleandmiseks ühelt prokurörilt teisele. Prokuröride konkursikomisjonile antakse pädevus kontrollida prokuröride vastavust teenistuskohale kehtivatele nõuetele, mittevastavuse korral on võimalik prokurör ametist vabastada. Prokuröridele kehtestatakse pikemad katseajad – abiprokuröridele üks aasta, ringkonna- ja riigiprokuröridele kaks aastat. Vanemprokuröride ning juhtivate riigiprokuröride ametiaeg muudetakse tähtajaliseks kestusega viis aastat. Riigi peaprokuröri ametiaeg muudetakse 7-aastaseks, ilma võimaluseta teda järjest teiseks ametiajaks ametisse nimetada, et tagada tema poliitiline sõltumatus kogu ametiaja jooksul. Ringkonnaprokuratuuride, samuti prokuröride tööpiirkondade kehtestamine muudetakse paindlikumaks. Asukoha ja tööpiirkonna kehtestamise volitus on edaspidi vastutaval ministril.
