Summary

Mr. Pascal Jenft draws the attention of the Minister of Regional Planning and Decentralization to the difficulties encountered by the municipalities concerning the payment deadlines of the compensation fund for the value added tax (FCTVA). Despite the FCTVA automation reform implemented since January 1, 2021, municipalities continue to experience significantly longer repayment times than municipalities. public intermunicipal cooperation establishments (EPCI), which benefit from faster payments. This situation seriously penalizes the cash flow of small and medium-sized municipalities, limits their capacity to undertake structuring investments (energy renovation, school, sports, cultural equipment, roads, etc.) and complicates the development of their budgets, due to the lack of being able to integrate with sufficient security the amount of VAT required to be refunded. While the automation of the system should strengthen the readability and predictability of the FCTVA, many local elected officials note on the contrary a gap between the needs of communities and the actual rate of payment of these allocations. This is why the MP asks the Minister, on the one hand, if the Government plans to align the deadlines for payment of the FCTVA of the municipalities with those of the EPCI, in order to restore equity between communities; on the other hand, if it intends to allow municipalities to register more quickly, from the budgetary year during which the investment is made, the amount of VAT eligible for compensation. He also wishes to know the measures that the Government intends to take to guarantee a more predictable and rapid payment schedule of the FCTVA, in order to secure the programming multi-year plan for local investments.
