Summary

Ms. Sandrine Lalanne draws the attention of the Minister of the Economy, Finance and Industrial, Energy and Digital Sovereignty to the regulations governing payment by check. While the number of checks issued has fallen sharply in recent decades, it now represents only 3% of transactions on French territory. Some of the European neighbors have already removed it. In fact, this means of payment is a source of fraud, falsification, unpaid debts and administrative costs for banking establishments. Furthermore, the regulatory framework governing this means of payment could become more coherent. A clarification of articles R. 131-20 to R. 131-22 of the monetary and financial code would thus make it possible to specify the methods of regularizing unpaid checks. Article L. 131-73 of the Monetary and Financial Code specifies that certificates of non-payment are supposed to be delivered by the banking establishments to the beneficiaries of the check in the event of a second unsuccessful presentation. However, banking establishments do not have the beneficiary's address, which leads to blockages. Also, article R. 131-31 of the Monetary and Financial Code sets the drawee a period of two working days following the justification to notify the Banque de France of the regularization. Some stakeholders report vagueness regarding this deadline. It should therefore be clarified that this begins when the establishment establishes regularization and not at the time the request is made by the drawer. Thus, she questions him on the measures that the Government intends to take in order to strengthen the effectiveness of the regularization methods governing this means of payment.
