La commission indépendante prévue par article 25 of the constitution, dont la loi no 2009-39 du 13 janvier 2009 fixe la composition et les règles d'organisation et de fonctionnement, se prononce par un avis public sur les textes fixant la délimitation des circonscriptions législatives ou modifiant la répartition du nombre de sièges de députés à pourvoir par département ou par collectivité d'outre-mer.
