Summary
Ms. Alix Fruchon draws the attention of the Minister of the Interior to the fight against the illegal occupation of housing and other premises, commonly referred to as “squats”. Law No. 2023-668 of July 27, 2023, known as the “anti-squat law”, was definitively adopted and promulgated in order to strengthen the protection of owners against the illegal occupation of their property. In particular, it toughened the criminal sanctions applicable to the offense of trespassing (up to three years' imprisonment and a fine of 45,000 euros) and extended these sanctions to the occupation of premises other than a main home, while creating new offenses linked to the fraudulent occupation of uninhabited property, including commercial or professional premises. It also simplified certain forced evacuation procedures by strengthening the role of administrative authorities and judicial, as well as by penalizing the promotion or incitement of squatting. If these measures constitute progress for the protection of property rights, many owners' associations nevertheless believe that the legal framework remains subject to improvement and that the procedures remain long when an occupation is not noted blatantly. In addition, some voices warn of the need to better articulate these responses with the social issues and the prevention of situations of extreme precariousness. In this context, she would like to know whether the Government intends to continue adapting the law in order to make eviction procedures effective and secure legal recourse against illegal occupations and whether additional measures are envisaged to prevent precarious situations which can lead to this type of occupation, by articulating more closely the fight against squats with housing and social support policies.
