Summary

Ms. Annie Vidal draws the attention of the Minister of Labor and Solidarity to a difficulty in applying Article 21 of Law No. 2023-270 of April 14, 2023 on corrective financing of social security for 2023. This article provides for the extension of the benefit of the pension increase granted to insured persons having raised at least three children to members of the agricultural self-employed scheme as well as to schemes insurance basic old age of liberal professions and lawyers. However, II of the same article sets the entry into force of this provision on September 1, 2023. This date of application has the effect of creating a feeling of unequal treatment between insured persons who liquidated their pension between the promulgation of the law and this date and those who made their retirement request after September 1, 2023. This This situation is noted in particular by certain members of the Old Age Insurance Fund for Chartered Accountants and Auditors (CAVEC), who believe they suffer a difference in treatment depending on the date of liquidation of their pension. She would also like to know if the Government plans to change this system in order to remedy this situation and avoid inequality between policyholders covered by the same scheme.
