Summary

Mr. Bastien Marchive draws the attention of the Minister of Transformation and the Public Service to the criteria for awarding the “old age” bonus in the territorial civil service. As part of the implementation of the Hospital plan, Decree No. 2020-66 of January 30, 2020, in fact, established a “old age” bonus, for the benefit of nursing assistants falling within the hospital public service and working in accommodation establishments for dependent elderly people (Ehpad) or any structures specializing in the care of elderly people. Due to its vocation to recognize the commitment of professionals working with elderly people and the specific skills necessary for their care, the Government wanted to extend the benefit of this bonus to agents of the territorial public service. Taken on the based on article 68 of law no. 96-1093 of December 16, 1996 as amended relating to employment in the public service and various statutory measures, decree no. 2020-1189 of September 29, 2020 thus allows the deliberative assemblies of local authorities or public establishments to institute this bonus, of a gross monthly amount of 118 euros, for the benefit of permanent agents and trainees within the framework of jobs for territorial care assistants carrying out nursing assistant or medical-psychological assistant functions, as well as contractual agents carrying out similar functions, within nursing homes or any other service and structure specializing in the care of the elderly. In fact, however, the bonus is not granted to personnel aspiring to join the territorial civil service, but recruited on the simple employment of social agent whereas, holders of the nursing assistant diploma, they actually carry out the function and the missions linked to this qualification. This even though this bonus would have been paid to them if they had been recruited as contractual caregivers. The situation is identical for qualified medical-psychological assistants (AMP) who do not have the entrance exam or are tenured at the “social agent” grade. In order to to correct these inequalities in treatment and restore attractiveness to a deficit employment sector in public structures, he asks whether these “social agents” could be included among the beneficiaries of the “old age” bonus on the basis of their diploma, as well as the function and missions actually carried out, and not on the simple criterion of their recruitment grade.
