Summary

Ms. Fatiha Keloua Hachi draws the attention of the Minister of Labor, Full Employment and Integration to the recognition of community utility work (TUC) and similar measures to take into account the long career system. While the regulatory texts were taken in August 2023 in order to specify the terms of application of the article giving entitlement to quarters for the aforementioned schemes, the TUC quarters being counted as assimilated and not contributed do not qualify for early retirement for long careers, which requires having validated the minimum duration required for the full rate, i.e. 172 quarters. This is particularly the case as specified in the explanatory memorandum of the proposed law by the co-authors of the dedicated flash mission of Arthur Delaporte and Paul Christophe but also in the report on the draft social security amending financing law for 2023 in which the rapporteur general of the Social Affairs Committee specified that it was “necessary for these periods to be “deemed to have been contributed” to give entitlement to the early departure scheme for long careers” (extract available on page 222 of the report). Consequently, it calls the attention of the Minister to the urgency of correcting the system so that these quarters are deemed to be contributed like other systems (periods of unemployment compensation, illness, etc.). It is important that the repair of this injustice does not open up other injustices for these women and men who participated in these systems and who are today heavily penalized, once again.
