Summary

Mr. Hervé Pellois draws the attention of the Minister of Action and Public Accounts to the inheritance processing fees applied by banks.     Le Gouvernement est particulièrement attentif à la question des frais bancaires prélevés par les banques. Ce sujet a fait l'objet ces dernières années d'importants travaux et le Gouvernement a pu œuvrer pour une plus grande transparence de ces tarifs. À ce titre, les établissements de crédit doivent informer leurs clients des conditions générales de banque qu'ils pratiquent pour les opérations qu'ils effectuent (art. R. 312-1 du code monétaire et financier). Cette information peut se faire par tous moyens: mise à disposition de brochures dans les agences, site internet de la banque ou envoi d'un courrier à la clientèle. Les frais de traitement prélevés lors d'une succession sont ainsi mentionnés dans les différents moyens de communication précités. Il convient de préciser que ces frais recouvrent non seulement le traitement des avoirs du défunt (compte de dépôt, produits d'épargne, assurance-vie…) mais aussi les interventions nécessaires, en fonction du degré de complexité de la succession (exemple: nombre d'ayants-droit, etc…). La transparence tarifaire doit permettre aux consommateurs de faire jouer la concurrence, seule à même d'agir sur le niveau des prix. Le Gouvernement entend donc maintenir son action favorisant le choix éclairé du consommateur. Une solution consistant à réglementer les prix n'apparaitrait pas dans ce cadre opportun. Un encadrement réglementaire des frais de succession pourrait conduire à fixer un prix supérieur au prix de marché et sur lequel s'alignerait the whole ofs établissements, voire à faire augmenter le prix d'autres services par compensation.
