Summary

Mr. Mustapha Laabid draws the attention of the Minister of the Economy and Finance to the organization of the competitive procedure with negotiation. Above the European thresholds, the procedures allowing negotiation with economic operators are the competitive procedure with negotiation (article 71 of decree no. 2016-360), the negotiated procedure with prior competitive bidding (article 74 of the aforementioned decree) and competitive dialogue (article 75 of the aforementioned decree). This first phase has a significant impact on the procedure time, with the risk of slowing down the use of this type of procedure or shortening the time dedicated to negotiations, which nevertheless constitutes the main interest of this procedure. This procedural cumbersomeness is all the less understandable in view of the impetus for simplification inspired by the latest reform of public procurement and even though the Government displays the desire to support innovation through public procurement. He therefore asks that the organization of this procedure be studied according to a so-called open procedure, allowing the simultaneous reception of applications and offers.

    Comme le souhaitait la France, la directive européenne 2014/24/UE, transposée par l'ordonnance n° 2015-899 du 23 juillet 2015 et le décret n° 2016-360 du 25 mars 2016 relatifs aux marchés publics, a élargi de manière importante les possibilités de recours à la négociation dans le cadre de la passation des marchés publics. Pour les pouvoirs adjudicateurs (articles 71 à 73 du décret n° 2016-360), l'organisation de la procédure concurrentielle avec négociation en deux phases, la première partie étant relative aux candidatures et la seconde on les offres, ainsi que les délais applicables à chacune de ces phases découlent des obligations prévues par la directive européenne 2014/24/UE elle-même. Il en est de même pour les entités adjudicatrices dans l'hypothèse de la procédure négociée avec mise en concurrence (procédure formalisée prévue par article 74 du décret), conformément à ce que prévoit la directive européenne 2014/25/UE. Toutefois, le délai de réception des offres peut être fixé d'un commun accord avec les candidats sélectionnés. En l'absence d'accord, la directive, comme article 74 du décret n° 2016-30, autorise l'entité adjudicatrice à fixer elle-même un délai qui ne peut être inférieur à dix jours. En conséquence, sauf à encourir une procédure en manquement, il n'est pas envisageable de modifier les règles actuelles des articles 71 à 74 du décret n° 2016-360. Ce n'est que dans l'hypothèse des procédures adaptées (articles 27 à 29 du même décret), dans lesquelles l'acheteur détermine librement la procédure applicable, dans le respect des principes rappelés par article 1er de l'ordonnance n° 2015-899, qu'il est juridiquement envisageable de prévoir une date unique pour la remise des candidatures et des offres.
