Summary
Mr. Jean-François Coulomme draws the attention of the Minister of Labor, Health and Solidarity to the situation of qualified practitioners outside the European Union (PADHUE). Unregularized, they operate on the national territory in conditions of great economic, statutory and administrative precariousness. Some are now threatened with removal from the territory. Their diploma not being recognized by France, these professionals health professionals, who represent a quarter of hospital practitioners according to the unions, are today required to undergo knowledge verification tests (EVC), which is a competition. Today, the EVC is the only route to full authorization to practice in France since the expiry on December 31, 2023 of the exceptional regime which until then allowed them to practice under various statuses. As a result, the PADHUE non-winners of this competition currently find themselves in a precarious situation in all areas. Remaining not tenured, many practice under the status of trainee, acting as intern (FFI) or associate practitioner and therefore do not earn beyond the minimum income. However, they have skills that are fully recognized by their peers and actually exercise positions of responsibility. From this situation This also results in great administrative precariousness, since they are forced to renew their residence permits every year. In addition, this competition has proven to be particularly severe. In a column published on January 17, 2024, nearly 220 foreign doctors, including many hospital practitioners and heads of emergency services, revealed that there were fewer PADHUEs accepted for the tests than places open in 2023. Thus, in certain specialties, the jury was below the number of places available. This selectivity is not justified by the level of the candidates, some having been refused even though they had an average of more than 15 out of 20. This seems completely aberrant given the context of tension in the medical sector in France today. This severity is all the more worrying since any failure in this competition opens the door to new regularization problems: doctors who have not obtained the EVC today find themselves without papers, their residence permit often being conditional on their work. As such, they risk being faced with an obligation to leave French territory (OQTF). On January 22, 2024, the Minister of Labor, Health and Solidarity, questioned on this subject, announced that temporary work authorizations for practitioners currently in post would be extended while waiting for them to retake the EVC in 2024. And this, pending the publication of the decrees implementing the so-called “Valletoux” law, providing for renewals of employment contracts for thirteen months in order to be able to retake this EVC competition. However, these are only provisional solutions, criticized by the unions of the professionals concerned and which appear contradictory with the hypothesis of the regularization of all PADHUE, outlined by the Prime Minister on January 30, 2024 and by the President of the Republic before him. The MP would like to know what measures will be taken concretely so that PADHUE currently practicing in France but having failed the EVCs of 2023 and who will fail the EVCs of this year and subsequent sessions, are neither removed from the territory French, nor ousted from their profession. He would therefore like to know if lasting regularization measures are planned for these practitioners, beyond temporary measures to extend work authorizations.
