Summary

Ms. Marie-Agnès Poussier-Winsback draws the attention of the Minister of the Economy, Finance and Industrial, Energy and Digital Sovereignty to the vulnerability of personal data of individual entrepreneurs distributed as open data via the public platforms Infogreffe and Data INPI. In application of current law, these platforms publish sensitive information with free access, such as the Kbis extract, complete civil status, as well as the personal home address of individual entrepreneurs, which serves as their registered office. If this transparency meets a legitimate requirement for legal security, it also constitutes a growing vector of crimes, with numerous identity thefts, misappropriation of addresses for fraudulent purposes, or even cases of harassment. The domiciliation solution with a third-party company, regularly mentioned, cannot constitute a satisfactory answer on two counts. On the one hand, it does not hide civil status data, the main causes of identity theft. On the other hand, to open a domiciliation contract, these private companies systematically require that the entrepreneur send them a copy of his identity card and his RIB. However, in a context where data leaks among private providers are increasingly frequent and repeated, this requirement poses an additional risk to the security of the entrepreneur's personal documents. In addition, all of these companies refuse single-use identity certificates generated by the state application France Identity, although they are designed to replace traditional CNI copies. Therefore, she wishes to ask what measures the Government intends to take, in the short term, in order to limit the publication of sensitive personal data of individual entrepreneurs without forcing them to use a third-party solution presenting risks to the security of their identity documents.
