Summary
Mr. Jean-Paul Dufrègne draws the attention of the Minister of Solidarity and Health to the conditions of application of the convention “insure and borrow with an aggravated health risk (AERAS)”. The AERAS convention experienced a major breakthrough in 2015 by establishing and enshrining in law the right to be forgotten in order to facilitate access to insurance and loans for people who have experienced a serious health problem, particularly people who have suffered from cancer. The amendment to the AERAS convention, signed on September 2, 2015, introduced two important provisions: the non-obligation to declare a cancerous pathology if its therapeutic protocol has been completed for more than 10 years (this deadline is reduced to 5 years for cancers diagnosed before the 18th birthday) and a reference grid for the pathologies concerned. This grid was expanded in 2018 to new pathologies and the notion of “active surveillance” opening access to borrower insurance to people with a cancerous pathology at a localized stage and with a low risk of progression. This is real progress. However, this is not enough. Indeed, it appears too often that the conditions for applying the AERAS convention still present difficulties, particularly for banks which do not do not always respect the rules of the system. He asks what measures the Government intends to put in place to ensure the proper application of the convention, in particular by strengthening controls and penalizing establishments which continue to hinder the conditions of access to insurance and loans for people who have suffered from cancer.
