Summary
Mrs. Emmanuelle Anthoine questions the Minister of the Interior on the status of religious congregations defined by the law of July 1, 1901 relating to the association contract. This status proves to be particularly restrictive, such that "the Republic maintains the congregations under a form of supervision" as stated by the President of the Republic Nicolas Sarkozy in 2007. In addition, this restrictive regime, which derogates from the common law of associations would contravene France's international commitments and more particularly the conventional law resulting from the European Convention on Human Rights. Freedom of religion (article 9) and freedom of association (article 11), as well as the principle of non-discrimination enshrined in this text seem incompatible with the maintenance of such supervision. This is why she wishes to know if the Government plans to remove this regime which derogates from common law in parallel with the upcoming reform of the law of December 9, 1905 concerning the separation of churches and state.
