Summary

Mr. Hervé Saulignac draws the attention of the Minister of Labor to the repeated dysfunctions of the direct mailbox distribution branch. Several parliamentarians, relaying staff representatives, had, several years ago, informed the Government of an edifying list of daily violations of labor law within companies in the sector and of the deleterious climate reigning within certain centers distribution premises. The case was then referred to the Public Prosecutor and the actions before the industrial tribunals all ended in the success of the employees who won their case without obtaining any change in the governance of the branch. The labor inspectorate, for its part, continues to be regularly called upon to note violations of the labor code and non-compliance with the collective agreement. While the negotiation sessions in the direct distribution branch were suspended for 18 months (from March 2016 to September 2017), they were only able to resume under pressure from the union federations, before, once again, a long interruption of work lasting a year. On September 18, 2019, all the union federations (CFTC, FO, CFE-CGC, CFDT) asked the general management of work to chair the next meetings of the joint committee in accordance with the CPPNI agreement, to determine the agenda as well as the work schedule. They would like, in fact, that particular attention be paid to this branch of activity which has often functioned poorly and that a competent third party could be a facilitator in the context of future exchanges. However, it seems that management General Labor Office indicated that it would no longer provide human resources and would not respond favorably to the request for the mobilization of labor inspectors. Also, he asks, on the one hand, if the ministry can reverse the decision of the general labor directorate to support the work of the branch and, on the other hand, what actions the Government intends to take with companies in the sector so that they comply with their legal obligations towards their employees.
