Summary
The possibility of combining remuneration from professional activity with unemployment benefits aims to encourage job seekers to return to work. This accumulation can occur in two cases: when an unemployment insurance beneficiary in the process of receiving compensation finds an activity (“resumption” activity), or when a beneficiary has several employment contracts and loses one or more contracts but in retains at least one (“retained” activity). The particular situation of employees who have several jobs for the same employer should be noted. Mainly concerned are the childminders of the private employer who look after several children from the same family in their home. The regulations applicable to them require them to conclude a separate employment contract for each child looked after. In the event that one contracts is terminated, the remaining activity(ies) are considered to be retained. The rules for combining allowance and salary are different depending on whether the activity is “resumed” or “retained”. The retained activity system makes it possible to fully combine unemployment compensation, based on lost activity, with retained activity, which is not the case for so-called “resumption” activity. This differentiated treatment can lead to significant gaps in compensation between job seekers. Therefore, the rules of retained activity can lead, in certain cases, to people benefiting from an overall income very close to a full-time activity by combining earned income and unemployment income. However, the Government did not wish to question the rules of the activity retained within the framework of the overall insurance reform. unemployment announced on June 18. This decision is consistent with the objective set out in Article 50 of Law No. 2018-727 of August 10, 2018 for a State serving a society of trust aimed at facilitating the establishment, development and maintenance of early childhood care systems.
