La loi no 2016-87 du 2 février 2016 créant de nouveaux droits en faveur des malades et des personnes en fin de vie, a pour objectif de mieux répondre à la demande de mourir dans la dignité par une meilleure prise en charge de la souffrance, de conforter la place de la volonté du patient dans le processus décisionnel par la désignation de la personne de confiance et l'amélioration de l'accès et de l'utilisation des directives anticipées. Cette loi affirme aussi que la personne malade atteinte d'une maladie grave et incurable peut revendiquer le droit à une sédation profonde et continue jusqu'à son décès. Elle introduit le principe selon lequel le patient, afin d'éviter une souffrance réfractaire et de prolonger inutilement sa vie, peut demander « un traitement à visée sédative et antalgique provoquant une altération profonde et continue de sa vigilance jusqu'au décès associé à l'arrêt de the whole ofs traitements de maintien en vie ». Elle précise les conditions d'accès à la sédation pour le patient.
