Summary
Mrs Annaïg Le Meur draws the attention of the Minister of Agriculture and Food to the differences in regulations existing between categories of recreational fishermen. In France, recreational and sport maritime fishing is practiced by approximately 2.7 million individuals; it is defined as fishing whose product is exclusively intended for the consumption of the fisherman and his family. The product resulting from this fishing cannot be knowingly sold or purchased. Although recreational fishing at sea is not subject to the acquisition of a license unlike freshwater fishing, it remains very regulated. Thus, the regulations determine the minimum size of catches, the type of fishing means authorized as well as the maximum quantity that can be taken. However, there are regulatory differences, particularly between underwater fishermen and trap and net fishermen. The example of spider fishing is revealing of the situation: for an underwater fisherman, the catch limit is set at six pieces per person per day, while for trap or net fishermen, the only limitation provided is that of the type and number of fishing gear and not a catch quota. Thus, in the same area, the trap fisherman has the right to fish as many spiders as he wants as long as he does it with two regulation-sized traps, while the spearfisherman is only allowed six catches. This distinction creates a feeling of injustice among underwater fishermen, who would like equal treatment between themselves and trap and net fishermen. Also, she wishes to know the Government's position regarding the possibility of harmonization of this regulation.
