Summary

Ms. Perrine Goulet draws the attention of Ms. Keeper of the Seals, Minister of Justice, to the application of the provisions relating to the provision of additional assistance to victims provided for by Law No. 2016-731 of June 3, 2016 strengthening the fight against organized crime, terrorism and their financing, and improving the efficiency and guarantees of criminal procedure. During the preparation of this text, parliamentarians adopted the specific provisions of article 82 of this law which provide in particular for the possibility of an increase, within the limit of 10%, of the fines, in contraventional, correctional and criminal matters provided for in article 132-20 of the penal code and of the financial sanctions provided for in articles L. 409-1 of the customs code, L. 612-42 of the monetary and financial code and L. 464-5-1 of the commercial code. These provisions, left to the assessment of the courts, allow additional funding for assistance to victims. This contribution allows in particular the financing of local associations which work in this area. These associations welcomed nearly 400,000 people in 2018; they fulfill essential missions in support, whether legal or psychological guidance but also long-term monitoring, which is one of the objectives of the 2018-2022 programming law. The finance bill for the year 2020 provides in particular for an authorization to commit 28.8 million euros for assistance to victims, with the stated objective of reaching nearly 30 million euros by 2022. Also, it wishes to know the frequency of application of increases in fines and financial sanctions previously described as well as the means it intends to implement in order to make these provisions known and how it considers it possible to encourage the courts to apply them.

    La place des victimes dans le procès pénal est tout à fait essentielle et le financement de l'aide aux victimes est une préoccupation majeure pour le ministère de la justice. Elle constitue un enjeu prioritaire en termes de responsabilisation des auteurs d'infractions pénales dans le cadre de la politique de réinsertion. Pour l'heure, peu de juridictions se sont saisies du dispositif évoqué de majoration des amendes prévu par article 132-20 paragraph 3 du code pénal depuis la loi du 3 juin 2016 renforçant la lutte contre le crime organisé, le terrorisme et leur financement, et améliorant l'efficacité et les garanties de la procédure pénale. Le ministère de la justice travaille actuellement à la mise en œuvre d'une expérimentation de ce dispositif sur le ressort d'une cour d'appel, en vue notamment d'appréhender les questions relatives à la traçabilité de la sur-amende, notamment au niveau des applicatifs informatiques et à sa prise en compte par les trésoreries, et ce afin de sensibiliser dans un second temps the whole ofs juridictions nationales et de les encourager à prononcer cette majoration.
