Summary

Ms. Constance Le Grip draws the attention of the Minister of Solidarity and Health to the procedures for obtaining active solidarity income (RSA) and the disabled adult allowance (AAH). When a person with a disability wishes to benefit from the AAH, their income - as well as that of their spouse, partner or PACS partner - are examined and must not exceed a certain ceiling set by decree, as specified in the article L. 821-3 of the social security code. Regarding an RSA request, articles L. 262-3 and L. 132-1 of the Social Action and Families Code indicate that the resources taken into account are all professional income, as well as the capital value of non-income-producing assets. The methods for evaluating these resources are set by decree. She would therefore like to know whether a beneficiary of the RSA or the AAH can see his allowance changed or eliminated if he becomes the bare owner of non-life housing, that is to say if he acquires ownership of real estate without however occupying it or receiving rent from it.
