Summary
The European Commission ensures compliance with deadlines and the quality of the transposition of directives into national law. However, if European directive 2010/63/EU requires in principle that animals used for scientific purposes must have been bred for this purpose and come from approved breeders or suppliers, it also provides for the possibility of granting exemptions from this provision in the event of scientific justification. La Commission européenne veille au respect des délais et à la qualité de la transposition des directives en droit national. Or, si la directive européenne 2010/63/UE impose en principe que les animaux utilisés à des fins scientifiques doivent avoir été élevés à cette fin et provenir d'éleveurs ou fournisseurs agréés, elle prévoit aussi la possibilité d'accorder des dérogations à cette disposition en cas de justification scientifique. Dans ses remarques adressées au Gouvernement français à propos de la transposition de cette disposition, la Commission européenne a relevé que article R. 214-90 du code rural et de la pêche maritime prévoyait bien des dérogations à ce principe sur la base d'éléments scientifiques dûment justifiés mais ajoutait « lorsque la production des éleveurs agréés est insuffisante ou ne convient pas aux besoins spécifiques du projet ». Cette précision n'étant pas prévue par la directive et ayant été perçue comme susceptible de faciliter l'attribution des dérogations, la commission a considéré que la transposition en droit national était erronée et a demandé à la France de la modifier. Le décret récemment adopté pour se conformer à cette demande de la Commission européenne lève toute ambiguïté sur le fait que les dérogations pourront être délivrées uniquement pour des impératifs scientifiques. Les dérogations, qui demeureront exceptionnelles, seront toujours accordées par le ministère chargé de la recherche après avis des autres ministères concernés.
