Summary
Mr. Antoine Savignat draws the attention of the Minister of Solidarity and Health to the application of Directive 2014/40/EU relating to the manufacture, presentation and sale of tobacco products and related products, which entered into force on May 20, 2020 in the public health code. According to the latter, the sale, distribution or free offer of flavored tobacco having a clearly identifiable odor or taste, other than those of tobacco, are prohibited. Although this represents real progress in reducing incentives for tobacco consumption, it would nevertheless appear that the marketing of certain flavored cigarettes persists. Indeed, recent sensory analyzes indicate that certain cigarettes, still marketed in France, produce a clearly identifiable sensation of freshness in the mouth, thanks to characterizing flavors prohibited by the directive in question. Such a situation is harmful for two reasons. On the one hand it is not consistent with public health objectives, on the other hand it seems likely to create unfair competition between distributors, to the detriment of those who have complied with the new regulations. He asks him if he intends to analyze these products and, if so, proscribe them.
