Summary
The private non-profit health, social and medico-social branch is characterized by a diversity of the conventional landscape, with numerous professional federations and collective agreements applicable and a multiplication of actors and issues specific to each collective agreement. These harm the readability of the sector while the challenges of harmonizing employment conditions and strengthening attractiveness are necessary: one employee in five is not covered by a collective agreement today. Since the summer of 2022, representatives of the sector have engaged in negotiations. They reached the conclusion of two agreements on June 4, 2024, one allowing the extension of Ségur to professionals who do not yet benefit from it, the other giving a framework and a timetable for the negotiation of the single extended collective agreement. These agreements were largely signed by the social partners. They are important for the attractiveness of the social and medico-social sector and the Government remains strongly committed to supporting this approach. The agreements were approved in compliance with Article L. 314-6 of the Social Action and Families Code, after advice from the national approval commission, of which three presidents of departmental councils are ex officio members. This approval makes them enforceable against the financiers of social and medico-social establishments and services (ESSMS) falling within the scope of the health, social and medico-social action branch. The autonomy branch, as the majority financier of the ESSMS, has already financed the implementation of this agreement to the tune of €300 million, from July 2024. For associations receiving State funding, certain compensation has already could be paid in 2024 as part of the end of management. Other compensation will be paid during 2025 following the entry into force of the 2025 finance law, as is the case for associations fighting violence against women.
